THIRD PARTY BENEFICIARIES. Buyer acknowledges and agrees that Mervis Equipment Sales, a division of Mervis Industries, Inc., their officers, agents and employees, are third party beneficiaries of this Agreement and shall be entitled to enforce this Agreement in their own names. 5. In the event that any term of this Agreement shall be found or held to be overly broad or unenforceable, such finding or holding shall not preclude the enforcement of any other term hereof.
